EEOC issues new workplace disability guide

The Equal Employment Opportunity Commission has issued a question-and-answer guide to help employers better understand the requirements of the Americans with Disabilities Act in a variety of situations.

The guide is meant to clarify a number of points.

For example, it states that employers can apply the same performance standards to all employees, including those with disabilities and it emphasizes that employers can enact basic conduct standards for all employees.

It also states employers' obligation to make reasonable accommodations for disabled individuals to meet performance and conduct standards.

"The EEOC continues to receive numerous questions on these topics from employers and from individuals with disabilities, indicating that there is still a high level of uncertainty about how the ADA affects these fundamental personnel issues," said Commission Chair Naomi C. Earp in a statement. "This document will serve a critical need and enhance compliance with the ADA."

The guide uses factual scenarios and examples to clarify certain issues under the ADA that employers often have questions about, officials said.
